GENERAL PROVISIONS

  • The State Encouragement to the investments are instituted by law 93-120 bearing 27 December 1993 promulgation of the Incentives Investment code. The investment encouragement in agriculture lies within the scope of this Code.

  • The investments in the agriculture, fishing sectors and the services related on are carried out freely subject answering the conditions of exercise in accordance with the legislation and the regulation in force.

  • The exercise of fishing requires a preliminary authorisation of the Ministry in charge of Agriculture.

  • The operations of Investment are the subject of declarations lodged with the services of the Agricultural Investments Promotion Agency in Tunis or in the place heads of Gouvernorats.

  • The foreigners resident or non-residents can invest in the agricultural sector realising hiring of the arable lands. However, these investments cannot in no case to involve appropriation by the foreigners of the arable lands.

  • The foreign investment in agriculture, fishing and the services related to these 2 activities is carried out within the framework of the partnership, the foreign investors can have to the maximum 2/3 of the capital.

  • The encouragement envisaged by the code are granted in the form of incentives common to several economic sectors and of incentives specific to the agricultural sector.

  • The provisions of the Incentives Investment code apply to the investment operations relating to creation, the extension, the renewal, the refitting or the transformation of activity.

  • With the exception of the investments in the completely exporting activities, the benefit of the incentives envisaged by the code requires the realisation of the investments financing diagram, comprising a minimum rate of the own capital stocks
